These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and XYON, a platform entity owned and operated by BCN Studio ("XYON", "BCN Studio", "we", "us", "our"), headquartered in Pune, Maharashtra, India. XYON provides a next-generation cloud gaming cafe management infrastructure serving both gaming lounge operators ("Cafe Owners") and esports enthusiasts ("Players").
BY ACCESSING OR USING XYON, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, ALONG WITH THE DIGITAL PERSONAL DATA PROTECTION ACT (DPDP) RULES 2026 AND IT INTERMEDIARY RULES 2026. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
1. Acceptance & August 2026 Statutory Framework
By registering an account, accessing our cloud dashboard, or utilizing any XYON client services, you expressly consent to these Terms under Indian Law, including:
- DPDP Act Rules 2026: Governing digital consent, data principal rights, and verified identity records.
- IT Intermediary Rules 2026: Mandatory cyber incident reporting and automated security notification guidelines.
- Consumer Protection Rules 2026: E-commerce transparency for billing, digital session receipts, and subscription cancellations.
Continued use of the platform after August 4, 2026 constitutes full acceptance of these modified terms.
2. Description of Services & Platform Architecture
XYON operates a unified gaming platform infrastructure consisting of:
- For Cafe Owners & Staff: Real-time session monitoring, automated hourly billing, console/PC asset control, happy hour scheduling, membership pass management, store inventory checkout, and financial telemetry analytics.
- For Players: Universal gaming profile, GX Points rewards system, session billing receipts delivered via Resend SDK, live leaderboard rankings, and location-based nearby cafe discovery with Haversine distance calculations.
3. Account Integrity, Device Security & Update Limits
3.1 Account Creation & Age Boundaries
You must provide accurate, current, and verified credentials during registration. Players must be at least 13 years of age. Cafe Owners and Staff must be at least 18 years old with legal business authorization.
3.2 Contact Update Limits (Max 2 Ever)
To protect user accounts from unauthorized takeovers, identity theft, and fraudulent reward claims, every XYON account is strictly permitted a maximum of two (2) Email updates and two (2) Phone Number updates EVER across the lifetime of the account.
Once the 2-update quota is reached, further changes are permanently locked and require manual verification through BCN Studio Support.
3.3 Smart Device Tracking & Security Alerts
Every login attempt records your device user-agent and IP address. Logins from unrecognized or new devices automatically trigger an instant Security Alert email dispatched via BCN Studio's email infrastructure. Non-primary devices inactive for over 30 days or created over 90 days ago are automatically purged to prevent stale access vectors.
4. Email Communications & Preferences
XYON dispatches automated communications through the Resend API platform:
- Mandatory System Alerts: Security login alerts, password resets, and critical service notifications cannot be disabled for security reasons.
- Optional Notifications: Promotional offers, GX Point milestone alerts, and session receipts can be managed anytime via https://xyon.bcnstudio.tech/player/settings.
- Legal Notice Footer & Unsubscribe: Every transactional and marketing email includes legal entity information for BCN Studio and a direct link to your Email Preferences section.
5. Geolocation & Nearby Cafe Discovery
When accessing the Nearby Cafes discovery feature (`/cafes`), XYON requests permission to access your browser's HTML5 Geolocation coordinates:
- Location data is processed in real time to calculate proximity (in kilometers) to registered gaming lounges using the Haversine formula.
- Coordinates are never stored permanently or sold to third parties.
- You may deny location permissions at any time and manually filter venues by city or search query.
6. Subscriptions, Payments & GST Compliance
Subscription fees for Cafe Owners are billed in advance in Indian Rupees (INR) subject to applicable Goods and Services Tax (GST). All fees paid to BCN Studio are non-refundable except as mandated under the Consumer Protection Rules 2026.
